Korea’s Startup Ecosystem Grapples with Scandals

Noise is mounting across South Korea’s startup ecosystem, with controversies erupting at every level—from government agencies and startup support organizations to venture capital firms and the startups themselves. Issues range from data leaks in government-backed entrepreneurship programs and financial data manipulation scandals at startups, to personal liability clauses in investment contracts and internal conflicts at public startup support institutions. While each incident differs in detail, they share a common thread: raising serious questions about whether the ecosystem’s systems of trust, accountability, and governance are functioning properly.

The most serious controversy involves a data leak from the Ministry of SMEs and Startups’ (MSS) “Everyone’s Startup” program. In a 155 billion won initiative, the email addresses, startup idea summaries, and judges’ comments of 5,000 successful applicants were exposed via vulnerable APIs on the program’s platform.

Following the breach, Acting Minister No Yong-seok issued a public apology and announced plans to overhaul the platform’s API security, strengthen access controls, and revamp personal information management systems. Despite these measures, the same platform operator implicated in the leak will continue to run the second cohort of the program, which is set to launch on August 20 with an expanded selection of 10,000 participants. This has left lingering concerns about whether the root causes have been adequately addressed.

AsWeMake, the operator of the B2B grocery platform QMarket, faced intense scrutiny after allegations surfaced that it manipulated financial data during a 50 billion won fundraising round. Due diligence by prospective investors revealed discrepancies in client records, sales figures, and bank balance certificates. An accounting firm named in the company’s audit report reportedly denied having issued the document in question.

In response, CEO Son Soo-young admitted to manipulating some sales figures starting in Q3 2023, resigned from his position, and the company announced it would shut down QMarket and cut approximately 60% of its workforce. AsWeMake says it will restructure around its B2B SaaS business to return to normal operations. However, with existing investors pursuing external accounting audits and legal action, restoring market trust remains the company’s top priority.

In another high-profile case, OGQ founder Shin Cheol-ho was held personally liable for approximately 120 billion won—covering 90 billion won in investment funds plus interest—under an “interested party” clause in the company’s investment agreement. This sparked widespread debate over whether investment contracts unfairly place excessive personal liability on founders for business failures.

In response, the MSS revised its standard venture investment contract in June to explicitly limit third-party joint and several liability and prevent undue responsibility for founders and related parties. The ministry later clarified that imposing joint liability on representatives or third parties without intent or gross negligence is prohibited, citing the OGQ case as a reference.

Similarly, UrbanBase’s former CEO Ha Jin-woo was confirmed to bear a repayment obligation of about 1.3 billion won under the terms of an investment contract. However, Shinhan Capital recently decided not to actually collect the debt, reportedly influenced by major investors who argued that it is undesirable to impose personal liability for business failure on founders without intent or gross negligence. This decision is seen as a significant shift in investor behavior, balancing legal rights with support for founders’ second chances.

These cases have intensified discussions on whether investment contract practices will evolve in line with institutional reforms to better protect founders from disproportionate personal risk.

At D.Camp, Korea’s largest bank-affiliated startup support foundation, CEO Park Young-hoon resigned amid ongoing internal turmoil. The labor union has demanded transparency regarding internal audit findings, board discussions, and future organizational plans, as well as investigations into allegations of workplace harassment and sexual misconduct with protections for victims. To date, management has not provided concrete responses or clear plans for organizational operations, leaving uncertainty about the foundation’s future direction.

Earlier this year, controversy also arose around the regulatory sandbox system. Lucent Block, a real estate fractional investment platform that operated under regulatory sandbox approval for over seven years, failed to receive preliminary approval for its tokenized securities (STO) off-exchange trading platform, pushing it toward potential market exit. This raised questions about how startups that test markets through the sandbox should be protected during the transition to formal regulation, and whether adequate exit strategies are in place. The Financial Services Commission has since pledged to explore institutional improvements to help innovative companies settle more smoothly into the mainstream regulatory framework.

The OGQ and UrbanBase cases, in particular, have brought founder personal liability into the spotlight, with attention now focused on whether these incidents will drive meaningful changes in investment industry practices and regulatory frameworks. As Korea’s startup ecosystem continues to mature, resolving these governance and accountability issues will be critical to sustaining trust and encouraging entrepreneurship.
